Privacy Policy of Smartmind LLC

Processing and protection of personal information of users of the websites, services and products of Smartmind LLC, including the ADM Connect mobile application.

1. General Provisions

1.1. This Privacy Policy (hereinafter — the Policy) applies to all information that Smartmind LLC (hereinafter — the Company) may obtain about a user (hereinafter — the User) while the User uses any of the Company's websites (hereinafter — the Site), as well as the Company's services, products or services (hereinafter — the Services), and in the course of the Company's performance of any agreements and contracts with the User.

1.2. Use of the Services means the User's unconditional consent to this Policy and to the terms of processing of their personal information set out herein. If the User does not agree with these terms, the User must refrain from using the Services.

1.3. The design, all texts, images, logos, photographs, sound files, animation files, video files, and other materials published on the Site are subject to the intellectual property rights of the Company or are used with the consent of the relevant rights holders. Rights to these objects are protected in accordance with the provisions of international legal acts and the legislation of the Republic of Uzbekistan. Any copying, reproduction, modification, distribution, republication, display, posting or transmission of any part of this Site is permitted only with the written permission of the Company. Viewing or printing individual pages is permitted only for personal use.

2. Users' Personal Information Processed by the Company

2.1. For the purposes of this Policy, "User's personal information" means:

  • 2.1.1. Personal information that the User provides about themselves independently in the course of using the Services, including the User's personal data. Information that is mandatory for the provision of the Services is marked accordingly. Other information is provided at the User's discretion.
  • 2.1.2. Other information about the User, the processing of which is provided for by the terms of use of individual Services.

2.2. This Policy applies only to information processed in the course of using the Services. The Company does not control and is not responsible for the processing of information by third‑party websites that the User may visit via links available on the Site and/or in the Company's Services.

2.3. The Company does not verify the accuracy of the personal information provided by the User and is not able to assess their legal capacity. The Company assumes that the User provides accurate and sufficient personal information and keeps it up to date.

3. Purposes of Processing Users' Personal Information

3.1. The Company collects and stores only the personal information that is necessary for:

  • 3.1.1. Providing the Services;
  • 3.1.2. Performing agreements and contracts with the User;
  • 3.1.3. Fulfilling legal requirements, including those relating to the mandatory retention of personal information.

3.2. The Company processes the User's personal information for the following purposes:

  • 3.2.1. Identifying a party within relationships, agreements and contracts with the Company;
  • 3.2.2. Providing the User with personalized services and performing agreements and contracts;
  • 3.2.3. Communicating with the User, including sending notices, requests and information related to the provision of services, performance of agreements and contracts, as well as processing requests and applications from the User;
  • 3.2.4. Improving the quality of the Services, the convenience of their use, and developing new functionality;
  • 3.2.5. Targeting advertising and informational materials;
  • 3.2.6. Conducting statistical and other research based on anonymized data.

4. Conditions for Processing Personal Information and Its Transfer to Third Parties

4.1. The Company stores Users' personal information in accordance with internal regulations and the requirements of the legislation of the Republic of Uzbekistan.

4.2. The confidentiality of the User's personal information is maintained, except in cases where the User voluntarily provides information about themselves for general access to an unlimited number of persons.

4.3. The Company has the right to transfer the User's personal information to third parties in the following cases:

  • 4.3.1. The User has consented to such actions;
  • 4.3.2. The transfer is necessary for the performance of a specific agreement or contract with the User;
  • 4.3.3. The transfer is required by the legislation of the Republic of Uzbekistan or other applicable legislation within the procedure established by law;
  • 4.3.4. The transfer is necessary to protect the rights and legitimate interests of the Company or third parties, provided that this does not violate the rights and freedoms of the User.

4.4. When processing Users' personal data, the Company is guided, among other things, by the Law of the Republic of Uzbekistan "On Personal Data" (No. ZRU‑547 of 02.07.2019) and other applicable legal and regulatory acts.

5. Changing and Deleting Personal Information. Mandatory Data Retention

5.1. The User may at any time change (update, supplement) the personal information they have provided, or part of it, by sending a corresponding request to the email address: info@smartmind.uz.

5.2. The User may also send a request for deletion of the personal information they have provided to the email address: info@smartmind.uz.

5.3. The rights provided for in clauses 5.1 and 5.2 of this Policy may be limited in accordance with legal requirements. In particular, such limitations may include an obligation on the Company to retain information changed or deleted by the User for the period established by law, and to transfer such information to a government authority in accordance with the procedure established by law.

6. Measures Applied to Protect the User's Personal Information

6.1. The Company takes necessary and sufficient organizational and technical measures to protect the User's personal information from:

  • unlawful or accidental access;
  • destruction, alteration, blocking, copying, distribution;
  • other unlawful actions by third parties.

6.2. Such measures include the use of secure connections, restriction of access to data, internal policies and procedures for handling personal data, and employee training.

7. Amendments to the Privacy Policy. Applicable Law

7.1. The Company has the right to make changes to this Privacy Policy. When changes are made, the current version indicates the date of the last update.

7.2. A new version of the Policy takes effect from the moment it is posted on the Site, unless otherwise provided by the new version of the Policy.

7.3. This Policy and the relations between the User and the Company arising in connection with the application of the Privacy Policy are governed by the law of the Republic of Uzbekistan.

8. Feedback

8.1. The User's email address provided to the Company is used solely for sending responses to the User's requests, unless the User has given separate consent to receive other information (newsletters, news, etc.).
